These terms of use (ToU) define the specific conditions for using the Klytic MTA service and supplement the Provider’s Terms and Conditions of Sale.
Klytic MTA may be offered in different forms and service levels. The Klytic MTA Essential level is automatically included with each Klytic Mail account and is not subject to a separate subscription.
Use of Klytic MTA Essential through a Klytic Mail account is subject to these ToU, within the limits of the features, capacities and conditions specific to that offer.
These ToU also apply to Klytic MTA offers subscribed to separately, subject to the specific features and conditions provided for the relevant offer.
Klytic MTA is intended for processing and filtering email flows in a professional context.
The Customer undertakes to use the service exclusively in compliance with applicable laws and regulations.
In particular, it is prohibited to use Klytic MTA to:
- send unsolicited bulk messages;
- take part in spam campaigns;
- distribute malware;
- run fraudulent or phishing campaigns;
- bypass third-party security or filtering mechanisms;
- attempt to compromise the Provider’s or third parties’ systems;
- use domains, addresses or identities without having the necessary rights;
- implement mechanisms intended to deliberately conceal the unlawful origin of traffic.
The Customer remains responsible for the lawfulness of the messages routed through the service.
The Customer is responsible for the email settings within its scope, in particular the domains, addresses, rules and accounts it administers.
Usernames, passwords, keys, certificates, access codes and other secrets required to administer the service must remain strictly confidential.
They must never be disclosed to an unauthorised third party.
The Customer must immediately renew or revoke any secret whose confidentiality has been compromised.
Administrator accounts must be restricted to persons who genuinely need them.
The Customer must provide the Provider with the information required for service sizing.
Particularly high requirements in terms of traffic, number of domains, message volume or concurrent connections may require an adaptation of the infrastructure.
Any significant increase in resources or specific service may be subject to a quotation.
Filtering mechanisms are intended to reduce the risks associated with unwanted, fraudulent or malicious messages.
No filtering mechanism can guarantee the identification of all unwanted or malicious messages.
The Customer remains responsible for implementing additional measures appropriate to its business.
In particular, it is the Customer’s responsibility to raise user awareness of the risks of phishing and identity spoofing.
If clearly abusive or fraudulent traffic is detected, or traffic likely to compromise the service, the Provider may temporarily limit or suspend all or part of the traffic concerned in order to protect its infrastructure and third parties.
The Provider may also require the Customer to take the necessary corrective measures before full service is restored.
The Customer is responsible for use of the service by its users, systems and applications.
In particular, it is liable for the consequences of a compromised account, misconfiguration, or use of the service in breach of these ToU where this falls within its scope of responsibility.
Subscription to Klytic MTA constitutes acceptance of these ToU.
